These Terms of Use (“Terms”) govern your participation in the Capsha.meme platform (the “Platform”) and the accumulation and use of $Capsha points. By accessing or using the Platform, including participating in any games, acquiring $Capsha points, or interacting with any related services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.
PLEASE REVIEW THESE TERMS CAREFULLY. BY PARTICIPATING IN ANY PART OF THE PLATFORM OR ITS GAMES, YOU CONFIRM THAT YOU UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS. IF YOU ARE ACCEPTING THESE TERMS ON BEHALF OF A LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE LEGAL AUTHORITY TO ACCEPT THESE TERMS ON BEHALF OF THAT ENTITY.
IF YOU ARE NOT OF LEGAL AGE OR ARE PROHIBITED FROM USING THE PLATFORM OR PARTICIPATING IN ITS ACTIVITIES UNDER APPLICABLE LAWS, YOU MAY NOT USE THE PLATFORM OR PARTICIPATE IN ANY OF ITS OFFERINGS.
The $Capsha points are intended solely for use within the Platform. They serve as part of the Platform’s loyalty and point system, allowing users to engage with Platform features. Points do not represent ownership, stake, or any financial interest in any entity, nor do they confer any rights or claims to profits.
Users can earn $Capsha points through daily participation in the Platform’s games. During certain phases, users may have the option to purchase additional points using cryptocurrency to extend their gameplay. Points are intended exclusively for Platform participation.
$Capsha points are not securities and should not be considered as investment opportunities. Points are solely designed as part of the Platform’s loyalty system, and users should not expect any financial return from holding or using $Capsha points.
Users who participate in the game and receive $Capsha points should not expect or anticipate any form of financial gain or appreciation in value. Points have no intrinsic or speculative value and are purely intended for use within the Platform.
You agree to comply with all applicable laws, regulations, and guidelines related to your use of the Platform and participation in any of its games.
You may not use the Platform for any illegal activities, and you agree not to attempt to use it for any financial or speculative purposes.
You acknowledge and accept that the prices of cryptocurrencies are volatile and can fluctuate. We do not make any representations or warranties regarding future cryptocurrency prices.
You acknowledge the inherent security risks associated with online platforms, blockchain technology, and cryptocurrencies, including the risks of hacking, unauthorized access to your wallet, and system failures. You agree that Capsha.meme will not be held responsible for any losses resulting from such risks.
TO THE FULLEST EXTENT PERMISSIBLE BY LAW, THE PLATFORM AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF GOODWILL, LOSS OF DATA, OR ANY OTHER INTANGIBLE LOSS, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM.
Any disputes arising from these Terms or your use of the Platform will be resolved through binding arbitration conducted in accordance with the rules of an established arbitration organization, in a mutually agreed location. You agree to waive your right to litigate in court, including waiving the right to participate in a class action lawsuit. Arbitration will be the sole method of resolving disputes between the parties.
Each party shall cover its own costs and fees associated with the arbitration, unless the arbitrator determines that one party must cover the other’s fees under applicable law. The arbitrator’s decision will be final and binding on both parties, and may be entered as a judgment in any court of competent jurisdiction.
Notwithstanding the above, Capsha.meme reserves the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent or stop unauthorized use of the Platform or violations of these Terms.
You agree to indemnify, defend, and hold harmless Capsha.meme, its affiliates, officers, directors, employees, agents, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising out of or related to:
Capsha.meme shall not be liable for any failure or delay in the performance of its obligations under these Terms due to circumstances beyond its reasonable control, including, but not limited to, acts of God, war, terrorism, civil unrest, government actions, labor strikes, internet service interruptions, or any other events that could not be anticipated or mitigated by reasonable diligence.
Capsha.meme reserves the right to modify these Terms at any time. In the event of a material change, notice will be provided to users via the Platform or email. Continued use of the Platform following any changes constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, that provision will be considered severable and will not affect the validity and enforceability of the remaining provisions.
These Terms constitute the entire agreement between you and Capsha.meme regarding the use of the Platform and supersede any prior agreements, discussions, or understandings, whether written or oral, between you and Capsha.meme.
These Terms and any disputes arising from or related to the Platform shall be governed by and construed in accordance with the laws, without regard to its conflict of law principles.
You may not assign any rights or obligations under these Terms without prior written consent from Capsha.meme. Capsha.meme reserves the right to assign its rights and obligations under these Terms without restriction.

Any attempt by individuals or entities from these jurisdictions to access or use the Capsha.meme platform is a violation of these Terms and is expressly prohibited. By using the platform, you represent and warrant that you are not located in, incorporated in, or a citizen or resident of any of these restricted jurisdictions.
